Be related with human's innate dignity inextricably, human rights have become the primary criterion to legitimacy of sovereignty and regime. Many thinkers have been probing connotation and accomplishing path of human rights, and the public also realize human rights, by means of resisting corrupt government and unjust social system. Undoubtedly, Philosophic theory and political practice both demonstrate the same truth that resisting the corrupt and unjust is the indispensable method of protecting human rights.Around three core themes—resisting is vital method of realizing human rights; corrupt legitimacy is archenemy of human rights; resisting the corrupt and unjust should not be labeled as anarchism and crime, the thesis analyzes classic western and oriental political theories and historic occurrences of resisting the unjust. From these, the treatise arrives at the incontestable conclusion that resistance is one of vital attributes of human rights, that's to say no resistance no human rights. Besides, the form of resistance is assorted in the thesis. Finally, through analyzing the magnitude and significance of protecting press freedom, strengthening human rights education and instituting human rights non-governmental organizations and Constitution review system, the treatise explores institution and amelioration of china's human rights-remedial system from perspective of resistant attribute of human rights.
