Consumers' Rights And Interests Protection Under The Network Environment

As a new kind of trade pattern, online trading has presented vigorous development in our country. Online trading depends on trade body's participation and network consumer is an important part. At present, the mainly legal protecting consumers'rights are "the Civil Law", "the Contract Law", "the Consumer Rights Law ", "Product Quality Standard Law", "Advertisement Law", etc. Under the network environment in protecting consumers'legal rights, our country still lacks the support of relevant laws and regulations. The phenomenon of infringing upon the legal rights and interests of consumers happens frequently, which will cause of consumers losing confidence online consumption and eventually restricting Internet development. Only the online consumers'rights get a full protection, the Internet will develop better. Therefore, making protecting system of consumers'legal rights and interests formulated and perfected under the network environment has become a top priority.This article through Example Method, Lists Method, Comparison Research Method etc, in the perspective of network consumers'Privacy and Right of Know, discusses the protection of consumer rights on the network environment. This paper is divided into three sections:The first part reviews the protection of consumers'rights under the network environment, including the network consumers'concept, characteristic and protection problems. Under the network environment, consumers'rights protection is facing with two problems:one is the network consumers'privacy protection problem, this problem essentially is consumers' privacy information protection; another is consumers'rights protection problem in shopping online and accepting the network business service process. The second protection range is consistent with practical environment, and the network environment is different from the realistic environment, the network environment has characteristics of virtual sex, openness, technical and digital etc, making the concrete form infringing consumers'rights and interests is greatly different from the realistic environment.The second section discusses the protection of consumers'privacy under the network environment. On the network environment, consumer privacy protection problems are collecting personal privacy information without consumer awareness or agreement and inappropriate using consumer privacy information. Our country does not have specifically targeted to consumers'privacy on the network environment. While the protection of existing laws and regulations involves privacy protection, but the provisions of the consumers'privacy protection related network are very simple, scattered, lack of maneuverability, unable to meet the requirements of consumers'privacy proposed law protection in rapidly developing network. While the international community about network consumers'privacy protection have relatively advanced legislation, therefore, it is necessary to draw on the experience of international society to design our network legislation system that protects consumers' privacy.The third part discusses the consumers'Right to Know protection on the network environment. Under the network environment consumers'protection problems are products with incomplete information, products information falsehood and false advertising. To eliminate these problems in the source, the most important done is that network operators must disclose something important information and the specific way. At present, in the two aspects our country is sill lack of some important laws. Therefore, we can draw lessons from international society's legislative experience to perfect our country's system of network operators'information disclosure obligations.
