The theme of this paper is "Animal Protection Legislation in China." After more than 3 decades of the "Reform and Opening-up", China is now experiencing a dramatic increasing in economic area. However it is hard to avoid problem emerge in possess, in terms of social equity, economic restructuring, political system. Narrow to the environment protection field, the consequence of ecological environment destruction, pollution, environmental emergency happens frequently, which never fall to catch public's attention. Zijin Mining accidents and Dalian Port tragedy are still remaining the society. The animal protection issues, however, has a lot of key relevant tied to the environment protection issue, therefore it is worth to be considered as a one of the top priorities. On the one hand, the wild animal protection legislation does not working efficiently as it supposed to be. On the other hand, the lack of animal welfare, not only hold back home livestock and poultry production, it may also bring in serious side effect against the public morals.The design of work as follow: firstly, a range of relevant theory from Animal Protection Legislationexpertwill be listed and analyzed in order to response following questions: What's the priory principal we need when dealing the relationship with animal?Why we need to protect animal? For it meets one's virtue equipment or it has a certainaesthetic value? If protecting wild animal is just an important way of maintaining ecological balance, what is the point of treating artificial feeding animals with kindness? Or such treatment is actually meaningless but an excuse to satisfy human's equality and justice. In this case,it is probably better to abandon all the meat production.The second is the analysis of the necessity of animal protection legislation. This part mainly points out the issues that need to be solved through animal protection law for major contemporary China. In other words we are concerning what kind of benefits can legislating animal protection bring to contemporary society. Third, the future prospects of legislation of animal protection in the future. China is now the lack of specialized animal protection laws, besides "Wild Animal Protection Law", there is only few relevant provisions of the laws and regulations. The drafting activity --"Animal Protection Law"led by Clement Chang is massive, but eventually sinks like a stone. So exactly when is the ripe time of legislating animal protection, if it is the time, what content should be included in the law.
