The adoption system has a long history, which Plays an indispensable role in human society. With the increasing international exchanges, more and more foreign adoptions appear, more and more people began to participate in activities of international adoptions. In the modern international community, international adoption has become a highly visible social phenomenon. The occurrence and development of international adoption makes the legal scholars face a new task. The United Nations established the norms of international adoption, which composed the basic terms of the international adoption. These norms established some of the principles of international adoption first, for example the principle of protecting the interests of children and the principle of combating illegal adoption. Hague Conference on Private International Law made the <Respect of international Adoption Convention on protection of Children and Cooperation >.As a new legal norm of international adoption, it is of great significance. The convention reflects the general trend of international adoption. That is strengthening the cooperation among countries, maximum protection of the interests of children, and so on.At present, China has become a big country of international Adoption. From 2006 to 2010, the number of children adopted in China has increased sharply. In contrast, there are some problems of the Foreign Adoptive legislation. Some legal gaps need to be filled. We have to study the contents of international treaties to promote the healthy development of foreign adoptions. Only the study of the international treaties can ensure the healthy development of foreign adoption.The thesis contains three Parts:The first Part is an introduction to the international Treaty on adoption. The second part is an introduction to Chinese Adoption Law. The third part is the legal amendments of the Foreign Adoptive Law. |
