Study On The Determination Of Crime Of Invasion Of Personal Information

February 28,2009 Seventh Meeting of the Eleventh National People's Congress adopted the "Criminal Law Amendment(7)" added the crime of invasion of personal information , is the general designation of the crime of selling,illegally providing personal information and the crime of illegally obtaining personal information.On the present,Purpose is to effectively curb the phenomenon of invasion of personal information in China's domestic,Protect the safety of life of individual citizens,Discipline suspects who Causing people's health,property or privacy suffered serious violations by violating of personal information.But judicial practices determination of the crime of invasion of personal information are more complicated,Because the crime of invasion of personal information is enacted in the latest revision of Chinese criminal law;it is not only in lack of more detailed interpretation,but also in lack of cases that can be drawn.So it brings puzzles to judicial practices.Under the guidance of the legislative intent, The paper tries to combine several cases of the crime of invasion of personal information occurred in domestic,consider some problems of new crime in judicial application process,To look forward to provide some references about the application of the crime of invasion of personal information in practice and the crime of legal interpretation in the future.
