On The Administrative Hearing System

Currently, the administrative procedure legislation boom is the rise worldwide. The system of administrative hearings, as the soul of modern administrative procedure law and the core, really reflects the civil rights respected and protected. However, the Administrative Hearing System still in its infancy, many provisions are not standardized, is not perfect. Therefore, improve and perfect the system of Administrative Hearings on the process of promoting the rule of law has a role in promoting better able to fully protect the legitimate rights and interests of citizens.In this paper, the reality, the use of theory with practice, from different levels in China make the present system of administrative hearing, in the analysis, based on the contact situation in our country on how to improve our administrative hearing system for the future made relevant recommendations to the administrative hearing system for our research and have implications for practice. Thesis is composed of three parts.The first part is an overview of the administrative hearing system, introduced the origin of the hearing, administrative hearing, the concept, characteristics, basic principles of administrative hearing system, and on this basis that the administrative hearing were classified.The second part is related to our current legal provisions of the administrative hearing system was introduced, and further pointed out that the related shortcomings.The third part is to the inadequacies of existing and proposed a number of improvement proposals.In short, we should accelerate the pace of construction of the administrative hearing system, further improve the system of administrative hearing, the administrative hearing system to more robust growth in China's vast, so more conducive to promoting China's rule of law construction, more conducive to the comprehensive protection of citizens legal rights.
