Study On Zhang Shen-fu's Constitutional Thought

Currently, most of the countries in the world realize the importance of constitutionalism. The constitutionalism is the only way for the development of democratic politics. Zhang Shen-fu is a figure who can't be neglected in intellectual history of modern China. His thought of certain uniqueness and representativeness is an indispensable part in the study of China's constitutional thought. This article focuses on Zhang Shen-fu's constitutional thought, China's national conditions as the basis, his philosophy as a guide, since the New Culture Movement to People's Republic of China was established, summarizes the putting forward,development and formation process of Zhang Shen-fu's constitutional thought. Zhang Shen-fu's constitutional thought includes the thinking of democracy, freedom and human rights. Through its constitutional processes depth understanding of China's development of constitutional law and development, summarize the constitutional movement for democracy and political experience for our current democracy-building experience.This article is divided into five parts.The first part is Zhang Shen-fu's scholarship and his political career, introduced the three stages of the development of constitutional thinking and the content of all stagesThe second part is Zhang Shen-fu's democratic thought. Including Confucianism western philosophy and Marxist thought.The conclusion section summarizes the overall situation of the article.
