Study On Non-profit Organization's Legal Regulation Of Profit-making Activities

From 1970s to the present, non-profit organizations have been greatly developed in the worldwide. After the reform and opening-up, China's non-profit organizations has also been rapid development with this unit the international trend. But, now, China's non-profit organizations also encountered a range of issues in their own development process. For example: whether it is official, semi-official or private non-profit organization, it is general lack of funding. Shortage of funds has become the biggest obstacle to the development of China's non-profit organizations. To resolve this problem, relying on government subsidies, social contributions, individual donations is not enough. As the main market economy, non-profit organizations must begin to explore the commercial operation and get revenue profit.This paper is to analyze this none-profit organizer's actives to gain the possibility and necessity of operation income. From the aspect of law, the paper discusses the possibility of profits none- profit organizations get, their Specificity and unfair which results from profits business. In order to deal with this problem, this paper suggests some laws and regulations and analysis the disadvantages.This paper has five parties: the first party is to analyze the notions of none-profits'organizations, its origins and distinguish them to come up with definition about it in china and stress them.The second party is to discuss the development of none-profit organizations and the source of capital income and then have the ways to expand their income from the capital difficulty they confront.The third party is to propose a suggestion that the government must allows none- profits organizations to gain profits based on the research on development of them and explain the laws and regulations and make some designs.The forth party is to discuss the unjust problem which results from the activities the none-profits organizations have and propose the laws to deal with them and make clear that we must regulate the tax laws and perfect the tax system.The last party is to analyze the disadvantages of tax laws and propose some advice to propose the none-profits organizations'development.
