The "human search first case" which arouse people argument had been came to a close.However,from this case we can see a new legal question:How to protect security of individual information under network environment.It is usually said that there is an information explosion in the 21st century.A lot of information spread rapidly by different medias. Similarly, as the foundation of society-each person, the individual information have increased quickly too.So the legal problem that how to protect individual information has happened. Some people think that individual information is the same as privacy,and individual information protection is privacy protection.But in my opinion,they are different.Privacy protection systerm can not solve individual information protection problems.Forever, professional study of individual information protection is indispensable.As previously described,a important reason for information explosion is network development.The developmen of networ has given many benefits to information dissemination and sharing.It not only give more conveniences to people,but also give more security risks to individual information.The "human search first case" is only one of individual information invasion cases which is happenning.In fact,more and more invasion behaviors are happenning,for example,improper accessing,illegal using.The problem needs to be solved is how to protect the security of individual information under network environment——individual information reasonable using and avoiding invasion. So, some countries and organizations has taken some steps, and formulates some legislative. But the legal system of our country is not perfect,more need to be done in the future.The object of this dissertation is protection of network individual information in civil law. And this dissertation is divided into five parts.Chapter one is about the details of the "human search first casr".and raising some questions from the case.Chapter two is the summary of individual information.It describes the the concept, character, classification of individual information.From this chapter,we can see that there are many differences between individual information and privacy. So it is very important to establish a system of individual information protection.Chapter three is the summaty of network individual information right. It describes the the concept, character, classification of network individual information right. And it points out that individual information under network is different from which is not.This chapter lists the rights of subject of network individual information.There is also importances of protect of netwok individual information and three modes of the power invasion to individual information under network environment.Chapter four is about the study of individual information under network.lt lists and analyzes the legislative system of typical foreign countries, such as USA and The European.The regulations of Hongkong and Taiwan are also analyzed in this chapter.Chaper five puts forward to the exceptions of individual information protection under network in China.lt looks at China's emerging civil law protection on individual information under network and trys to give some suggestions.
