The public price hearing system is designed to democratize public administrative decision-making. It provides government, the public and market agents with a platform to communicate and share information. It helps to improve the quality of governmental public service, promote the subject awareness and participation consciousness of the public, and reinforce the management of enterprises, making executive power to be legal, reasonable and democratic. The public price hearing reveals theories of modern administrative management, and acts as a measurement of constructions of service-oriented government, open government, effective government and democratic government. It is a symbol of political system reform and new way of political operation.The public price hearing is the core of administrative procedure. Nowadays, there are wholesome separate legal norms in China, such as"Regulations on Price Hearing for Governmental Price-making"and relative regulations made by provinces like Hunan and Shandong. The existing theories and practice show strong support for making a unified administrative procedure law.The history of public price hearing is long and it is well enforced in foreign countries. Recently, achievements are made in relative studies on price hearing in China, but mostly focus on administrative hearing. Although we lack monographs on price hearing, scholars make comparative studies on representatives, holders, organizations, procedures, etc. and promote their suggestions on how to improve the system. This paper is divided into four parts:The first part begins with analysis on definition of price hearing in order to distinguish it from its upper concept. Then, the author will illustrate some important concepts in legal norms.In the second part, the author makes comparative study on domestic and foreign price hearing systems, based on which the author tries to construct a framework of price hearing by referencing experience of foreign countries according to Chinese specific situations.In the third part, the author analyses the practical difficulties and its causes from the perspectives of the economics of regulation and law, in order to illustrate systematically the conflicts of interests of different groups.In the fourth part, the author promotes suggestions on how to improve price hearing system, from perspectives of the public,market agents, experts, and government, that is, some practical implementation rules for praxis. Furthermore, the author promotes suggestions on improvement of thinking model of price hearing.
