Research On Constitutional Protection Of Cultural Rights Of Citizens

Cultural rights of citizens refer to the social and cultural life of citizens who could enjoy the inviolable freedoms and interests. Cultural rights of citizens as a kind of human rights, but compared with political rights and economic rights, it is the most immature department, "not developed department" and a kind of "neglected human rights". Safeguarding cultural rights of citizen is an important constitutional obligation, however, due to various constraints, our constitution rules for safeguarding of culture rights exist many unsatisfactory place. This article attempts from aspects of constitutional law, thoroughly analyze the connotation, essence and security status of cultural rights of citizens in order to implement cultural rights of citizens better.The dissertation consists of five chapters. The introduction gives the original intention of topics, research status, logical thinking, and also tells the innovations and insufficiencies of the dissertation.The second chapter is the jurisprudence foundation of cultural rights. The author theoretically analyzes and combs a series of viewpoints about cultural rights, and tries to redefine this controversial conception through regulation certified. The whole dissertation is based on the comparison and contrast of relevant concepts. On the base of these definitions, the author analyzes the characters, the key elements, and the necessity of protecting this right. To the further, point out the exact holder of this right. This study will also pave the road for solving the uncertainty of the subject of cultural rights and insufficiency in legal practice.The third chapter is the constitutional protection status of cultural rights of Chinese citizens. Firstly, the article elaborates the protection status of cultural rights of citizens on current constitution, analyzes the constitutional protection way, finds out the characteristics and causes of the constitutional protection, and attempts to have a preliminary understanding of the status of cultural rights. The fourth chapter is about perfecting constitutional protection system of cultural rights. The author puts forward several suggestions to perfect the constitutional guarantee of culture rights, in order to implement cultural rights of citizens better.The fifth chapter is the summary. To summarize the whole article, hoping the ideas presented in the paper could provide reference for others'study and attract more scholars and experts to do research on the protection of cultural rights.
