To based on citizens demand to protect their privacy, plus the overwhelming majority of the world's countries have attented the constitutional protection of privacy, not only there are many theoretical innovation on theoretically, But also it has been established privacy laws in practice, especially many countries of the world have started to the constitution for protect privacy. Facing the constitutional protection of privacy develop international trend, in order to safeguard the personal dignity of citizens betterly, and to promote the establishment of socialist harmonious society, so it is necessary to discusse the citizens of the constitution to protect privacy.This study aims to perfect our country's basic rights of privacy as the constitutional protection problems,it has mainly three part analysis:The first, discusses the basic meaning about privacy, and clear the connotation, the basis of protection about constitutional privacy, the basic right attribute and the significance to the constitutional protection of privacy in today. The second, from our current system for privacy settings and the present situation of privacy protection in China to descusse the defects about the protection our constitution in privacy;The thirsd, this section mainly analyzed the basic rights as a constitutional right to privacy that should have the standard effect in China through discussing the constitution to foreign privacy protection and the basis of the above methods, to perfect our privacy and protection constitution of basic rights based on the discussion of validity, and furtherly discusses the legal protection for privacy. So this article put privacy as our constitution right what protect a citizen's fundamental rights, The realization of the constitution protects basic rights defense needs not only the validity of the state public power,but also including the validity of the basic rights of positive security requirements and need the fundamental rights of the effectiveness of multiple effect, and perfect the system from the normative aspect, and emphasis the judicial relief on privacy,so it can really help citizens' right of privacy to carry out feet.
