Discussion Of The Government Adjustment To Labor Relation In Private Enterprise At Present In China

Although the private enterprise can promote economic growth and the accumulation of social wealth, increase employment and maintain social stability, it also could increase the risk of hurting labor relation. Now the situation that capital is more powerful than labor is very serious, and the unipolar tendency is very clear, moreover, the deeds that private enterprisers harm labor often occur. For China being in a course of changing currently, it isn't realistic that capital and labor spontaneously form orderly, cooperative interaction in accordance with the party autonomy principle. The reality demands that China should follow a distinctive path that the government establishes and improves an intervention mechanism for dealing with labor relation, especial private enterprises' labor relation.The article selects the problem for research that Chinese government interferes labor relation of private enterprise. In the light of logic turn the article fully develop from three levels which include present case of labor relation of private enterprise, foundation by which the government interfere labor relation and intervention mechanism of the government interferes labor relation of private enterprise. Firstly, the author sorts through the feature which labor relation of private enterprise appears nowadays, including specialty, non-equality, non-stability, stratification and non-norm, also generalizes main problem which exist in each procedure of labor contract, labor process, labor management, labor remuneration and dispute reaction. Secondly, the article expounds the foundation which the government interferes labor relation of private enterprise respectively from three aspects such as responsibility which the government should take in the field of protecting labor right, advantage of the government's powerful mobilization ability which the post all-round authority system brings and the government intervention in labor-management cooperation is more conducive to achieving the best game. Finally, the article constructs the mechanism that the government interfere labor relation of private enterprise from three aspects, namely subject set up, role played and measure took.
