| Because the "greenhouse effect" caused by global warming has been the concern of countriesin the world,but human activities are the main source of emissions. To civil aviation industry,aircraft engines,aviation fuel combustion gas emissions generated by air transport is a major sourceof pollution on the environment. Relying on the sustained rapid growth, China's civil aviationindustry in the forefront in the world,the pace of development,the scale of development after theUnited States,ranking second in the world. With the expansion of the size of the civil aviationindustry,CAAC is very arduous task of energy saving. Meanwhile,the globalization of air transportcharacteristics of the work of our civil aviation industry in energy saving energy saving andinternational air transport is closely related to the overall development situation,to grasp some ofthe major events and accurately assess their impact on the development of civil aviation,positiveresponse,more is the current focus on energy saving work. It is particularly worth mentioning isthat,at present we are in the rapid development of domestic and international aviation industry oflarge-scale environment,the low-altitude airspace opening management has become a necessity topromote the development of general aviation,the paper focuses on how to prevent and control airpollution, especially tailing gas pollution of the aircrafts after China's opening of the low-altitudeairspace. Then the paper makes some recommendations for improving the current ligislation andregulation from the perspective of comparative law.The paper is divided into six chapters:Chapter One introduces the setting of the thesis, its significance, research methodology andits originality and shortcomings. The originality of the thesis lies in that it is the first study to makean analysis of environmental pollution related to low-altitude airspace from a legal perspective at atime when China is going to broaden its low-altitude airspace.Chapter Two discusses the relationship between low-altitude airspace development andenvironmental pollution by first defining low-altitude airspace, followed by the description of thecivil aviation development and its according environmental pollution as well as its negative impactson people's life.Chapter Three explores legal counter-measures in foreign countries or regions. A comparisonhas been made to detail their legislation on and legal measures for emission reduction in aviationfield. US, EU, ICAO and IATA are illustrated.Chapter Four The fourth part presents an overview of China's control of environmental pollution in low-altitude airspace and laws and regulations, coupled with issues and deficienciesidentified in emission reduction policy in the civil aviation industry.Chapter Five proposes legal counter measures, such as adoption of emission reductiontechnology, promotion of carbon set-off measures, establishment of carbon-added tax and carbontrading mechanisms. In addition, an addition of a advocating provision for emission reduction isproposed for the future revision of the Civil Aviation Law.The last chapter concludes the thesis with an appeal for creative legislative efforts for thecontrol of environmental pollution in the civil aviation sector under the present legal framework,thus achieving win-win goals between economic development and environmental protection in thissector. |
