Study On The Legal System Of Chinese Coal Mining Area Land Reclamation

The proportion of coal has a share of 70% around in China's primary energy consumption structure; obviously, the coal plays an important role in the national economic development and people's lives. However, large-scale exploitation of coal resources, on the one hand promotes the development of China's economic construction, on the other hand has brought many problems, resulting in destruction of land mines, environmental pollution and ecological imbalance. What's more, the ground surface subsidence of the mine cause varying degrees of damage to buildings, roads, railways, bridges and power lines; in the plains crowded of villages, the land subsidence causes destruction to villages, and causes population migration. Destruction of land within the mining area reduces cultivated land, damages the ecosystems and landscapes, increases the contradiction among the population, resources and the environment, affects the organic unity of economic, social and ecological benefits of the coal mining areas, and restricts the sustainable development of the whole society. To mitigate these conflicts and achieve sustainable development, it's necessary to improve the guiding regulations on land reclamation in the level of the legal system, strengthen the construction of land reclamation work in mining areas, and implements the nation's policy of "dynamic balance of cultivated land".The sequence of research first of all understands the related concept of land reclamation and the basic theory,then introduce the advanced experience of land reclamation in the USA and Germany , last in the case of socially acceptable recommend systems and regulations of their success , expect to provide recommendations for legal system of land reclamation in china . This research is divided into five parts , the first part clarify meaning of coal mining area land reclamation at home and abroad and characteristics and principles of land reclamation ; the second part describes coal mining area land reclamation based on the theoretical basis and pave the way for the later study ; the third part analyzes superior system of coal mining area land reclamation in USA and Germany ,provide advanced experience for coal mining area land reclamation in China ; the forth part gets to the bottom of the problem and the key to solve the problem ; the fifth part is where the purpose of this article ,previous research is to improve the related systems of coal mining area land reclamation in our country ,how to reference the earnest money of the United States and the planning system in Germany to improve the institutional system with China's national conditions , and on this basis , the difficulty and emphasis is how to realize the industrialization of coal mining area land reclamation . Through the improvement of system construction to solve the low rate problem of coal mining area land reclamation in our country is essential ,therefore ,we must pay attention to them .
