| Peking University from the July 2009 has made the decision of the implementation of "Real-name Principal Recommendation System"in order to select high school students of features. In the November 2009, it issued the "Peking University Recommendation System on the Trial Implementation of Secondary School Real Name Principals", which obtained constant oppositions. In response to the public question, the reasonable and legal analysis of the " Real Name Principal Recommendation System" is one possible way, indicating its confirmation and acceptability. This paper focuses on the legitimacy and rationality that "the Real-name System" promoted by Peking University, the details are as following.The first part is introduction, introducing the research background, and promoting questions. In the higher education process, people's awareness of rights and educational equity has been developed into an unprecedented stage. In this cultural and psychological atmosphere, the promulgation and implementation of secondary school principals real name by Peking University arouses the author's attention to its rationality and legitimacy of self-admission policies, which would beaome the major problem to be discussed in this paper.The second part is to introduce the objectives, content and social repercussions resulted from "Real-name System in Peking University. The paper will have a further analysis on the deep meaning of this aspects based on the present researches.The third chapter is attempted for the rationality analysis on the recommendation of "the Secondary School Real-name Principals" proposed by Peking University, which is to be analyzed from the two aspects. First, we must take the direction of policy into account, whether it is to enhance maximim well-being of the public, or whether it is for the purpose of compliance with the objective requirements of social development. In the context of higher education, "Secondary School Real-name Principals System is in conflict with the goals of higher education, which does not meet the objective requirements of social development. The policy of Real-name System can not to the greatest extent enhance the social well-being of the public, since it obviously tends for partial students, ignoring or even violating the right of other students. Second, the policy of fairness, justice and the pursuit of universal values of society must be considered. Fair education is a subjective value judgment on the education market and society, based on the evaluation criterion that people obtain its fairness and reasonableness. Many unfair factors caused by Real-name Recommendation Policy is rether obvious, which is specifically presented in the beneficiaries of this policy and areas.The fourth part is about the review on the legitimacy of the Real-name Policy recommended by Peking University. To teach under the specific laws is not only the basic principles of educational management but also the principle for higher schools enjoying self-admissions to students and making enrollment policies. The beneficial objects that "Real-name Principal Recommendation System" by Peking University are those students with "comprehensive quality and outstanding specialty" from 39 secondary schools in the 13 relatively developed provinces and cities of 34 provinces and autonomous regions. If we balance it from Article 1 of "General Provisions" of the "Higher Education Act" and Article 19 from the "Constitution"being of the principle of equality, this system violates the constitutional principle of equality, disagreeing with the legislative purpose and the basic spirit of the "Higher Education Act". This part is also about the influence that the Real-name Principal System imposed on the education market, justice and order, fairness and efficiency from the aspect of law and the reasoning, thinking it can not be an integrated body to form justice and order, fairness and efficiency in the education societyand market.The fifth part is the conclusion including the following points:(a) full attention should be paid to the positive significance of self-admission system in universities; (b) University admissions policies should be developed independently according to law and implementing the basic principles of teaching with the legitimacy and effectiveness; (c) the order and justice, fairness and efficiency values should be reflected when the universities promote self-enrollment policy. |
