Equal pay for equal work is the basic principle established by the labor law in our country.In order to prevent discrimination against workers in the labor remuneration distribution.As a new form of employment,labor dispatch has developed rapidly these years because of its flexible and special form in employment,and it expanses employment and alleviates the employment pressure.However, due to the lack of necessary supporting laws and regulations and the separation of employment and use,situation of damage to workers’ rights and interests always happen.Especially the equal pay for equal rights of the labor dispatch employees usually not guaranteed.It is difficult for the labor dispatch staff to have the equal pay as the formal workers.Shanghai’s labor dispatch staff has a large scale,widely distributed in the party and government organs, institutions and enterprises.There is a phenomenon of labor dispatch employees can not enjoy equal pay for equal work in these organizations.The cause of this situation is extremely complex.The mainly cause are:Labor unit has the inherent impulse of saving human capital expenditure;There is no consistent understanding of the unit and the laborer equal pay for equal work;The relevant laws and regulations are not clear;Labor supply is greater than demand makes workers in a weak position;Labor dispatch staff awareness is not strong;Trade unions are not fully played;Enterprises to fulfill their social responsibility consciousness.This paper analysis the experience of the developed countries to ensure enterprise employees with equal pay for equal work rights, and then give the suggestions to the unequal pay in the labor dispatch in Shanghai.The suggestions include:Improve relevant laws and regulations;Strengthen organization and leadership;Further promote the construction of trade unions;Strengthening the construction of enterprise democratic management system;Strengthen propaganda.
