Compared with its booming overseas investment practices,there are still some problems and legal risks in the course of overseas investment.This article tries to explore the legal risks happening in the courses of China overseas investment,including the categories of the legal risks, the causes leading to the legal risks, the harm caused by the legal risks and the relevant precautions of the legal risks.In Part One, the article explains the general information about overseas investment.The author firstly introduces the history and status quo of China overseas investment,then lists several forms of overseas investments.The author also explains the basic legal systems of China overseas investment.In Part Two, the article mainly focuses on the legal risks faced by China enterprises in the course of overseas investment.There are economic, political and legal risks happening in the overseas investment.The author defines the concept and main characterizes of legal risks and then lists several common legal risks.In Part Three,the author analysis the reasons leading to the legal risks of overseas investment and the hazardous nature which the legal risks of overseas investment produces.Incomplete legislation of oversea investment,especially the unnatural examination and approval system for overseas investment plus the other reasons result in the legal risks and leads to the relevant social and economic hazard.In Part Four,the author proposals the solutions and suggestions to prevent form the risks in the overseas investment.Given that the different roles playing by the government and overseas investors,both of them should take different measures to guard against the legal risks happening.
