| The Chinese export of trade in service has increased remarkably in recent years. But there is no focus on this item and the most importantly the barriers to trade in service which China encountered in the export. This thesis aims at analyzing what kind of legal barriers the Chinese export of trade in service will encounter and how to deal with this problem in the framework of GATS, choosing America, Japan and EU which are important partners of China in trade, and the sector like tourism, transport and construction service which are the most important industry in Chinese service as research materials. The research will focus on the General Obligations and Disciplines, Specific Commitments on Market Access and National Treatment in order to realize the legal barriers which GATS will accept. After the analysis and research, the thesis will have the outcome as follows:countries will build legal barriers in accordance with their specific commitments under GATS. Unlike the common sense, the developed countries also will have large numbers of barriers to trade in service and limitation in market access especially in Presence of natural persons. It is also noticed that different industries will have different commitments and barriers according to the characteristic of their Modes of Supply and the countries'interests. We also can find that the barriers to transport service is the most serious in the three industries mentioned above. As for China, we should make use of the different countries'commitments in which they promise to take obligations and breakthrough the legal barriers by means of negotiation in the framework of GATS. The most important thing is to safeguard our own interests using rules and regulations of GATS. |
