On Embezzlement Of Public Funds Constitute A Crime

There is a lot of controversy about the crime of embezzlement in the perspectives of both theoretical circle and judicial practice. How to fundamentally solve the many problems in the crime of embezzlement becomes a hot topic and have been concerned by the legislators, the judiciary and academics. The author recognized that the only way to fundamentally solve the controversy over this crime is perfecting the constitution of crime of embezzlement in the existing criminal law. This paper describes the legislative history of the crime of embezzlement, analyzes the constitution of this crime, puts forward suggestions of relevant legislation, and demonstrates these opinions theoretically.
