In the backgrond of economic globalization, information and speed the flow of information is strengthened, the commercial value of personal information is unprecedented and making China's current protection system of personal information face serious challenges and need for new protection legislation and norms.With the rapid development of information technology, modern society more and more depands on personal information.Property interests becoming increasingly prominent. At the same time, the use,collection, storage and transmission of personal information by national institutions and business associations has also become more frequent, generalized and simplified. this will help govornment and commercial organizations to provide more business opportunities and improving the management efficiency; but as the introduction of this article said, lack of regulate the collection and disposal of personal information may cause a great property damage to individual interests, and thus distorted, demeaning human dignity and freedom of control, self-determination. Because of lacking relevant legislation, the existing legal framework can not give systematically and effective judicial relief. Law should focus on social development. Although our government has introduced the legislative program for protection of personal information, but the domestic law of the academic research in the basic theory is lack, especially in jurisprudenceIn contrast, the United States, European Union, China's Taiwan and Hong Kong, their personal information protection legislation is very comprehensive, theoretical studies have reached a very mature stage. Because of this, this paper describes the legal concepts and legal attributes of personal information, and clarify the difference concepts of it between China and United States. Finally come to the conclusion: the proceed of protection of personal information should be based in China's background, and referent the experience of developed countries and regions. At the end,the article brings out the concept of the personal information right to gave some basic academic surpport for making personal information as a legal right.
