Civil society, defined not only the equal relationship between the citizens and,more importantly , individual citizens as well as indication of the overall country vis the political relationship between a liberal democracy .freedom, and its basic spirit of freedom and democracy constituted a barrier to protect individual citizens and at the same time on the country to form an effective political constraints.The basic spirit of the civil society and the individual rights of its power to protect the country's dual function ,and up near the modern sense of the constitutional spirit of the kernel are the same views, it can be asserted that civil society is the cornerstone of building a constitutional democracy. China because of the economic and cultural impact, civil society-building has just started, the true sense of the formation of civil society has not yet been entirely constitutional significanc also, and easy use of our country can not sovel the actual problem, so the transition period must be based on conditions established in China ,from the nurturing of civil society with Chinese charactertristics start to lead to constitutional democracy in China and the rapid formation of successful. In this paper, namely,the constitutional and civil society from the basic concepts and theories start to try to resolve the constitutional construction of civil society are the basic proposition of the society, in the study of China's civil society adopted on the basis of the status quo of Chinese,and then raised at build civil society in contemporary China's countermeasures have to attention ,with a view of civil society through research, grasp the context of social development and promote China's constitutional development.
