Minorities Special Needs Of Commodity Management Legislation

As special natural and geographical conditions and economic environment in which the minority lives, they have formed their own history, cultural traditions, customs, religious beliefs and life styles, created a unique nation identity. In order to exhibit nation characteristic and maintain the necessary production and life, commodities with a specific purpose, specifications and style, and at the same with culture concentration come into being in each nationality, it's called special commodity, including textiles, clothings, shoes and hats, culture-physical and religious supplies, furnitures, household miscellaneous supplies, production supplies, arts and crafts supplies, drugs, border-sale teas and so on, which relate to all aspects for clothing, food, housing, culture, life and so on of minorities, and it's of great significance for minority in production and life.The departmental rules are the main legal norms for special commodity management with different preferential policies prescribed in different regulations in China, which is lack of professionalism and systematic, and is very asymmetric with the requirements of special commodity management, so the law for special commodity management with profession and system is urgently constituted. Meanwhile, the research on special commodity management for minority is lagging behind in theory, only some chapters of individual books and papers discusses the special commodity management issues relating to the theory and practice, and the content is relatively shallow, so it is time to further research it by systematic method. It is a practical issue to legislate in special commodity management, this article researches the said issue by the methods of field research, comparative studies and literature research.This article is divided into five chapters, the main contents of each part as following:The first chapter: Summary of special commodity management legislation of minority. Analyzes the concept of special commodity of minority; dissertates the development process of the special commodity management of minority, introduces the four stages of special commodity management policies before reform and opening up, and gives a special analysis of special commodity management policies after the reform and opening up; makes a discussion on the status of special commodity management of minority by perspective of laws, regulations, rules, local laws and regulations, Regulations on the Exercise of Autonomy, Specific Regulations. ChapterⅡ: The basic grounds of special commodity management legislation of minority. dissertates the theory basis of legislation by the perspective of human rights of minority's rights to subsistence, rights to development and rights to obtaining material assistance and culture and so on; makes a discussion on value orientation of special commodity management legislation for minority by the aspects of urgency and feasibility of special commodity management legislation.ChapterⅢ: Analysis for legislative policies of special commodity management of minority. The article focuses on detailed discussion on the status of special commodity management through analysis of achieved effects and existing problems of special commodity legislation and policies.ChapterⅣ: Perfection for special commodity management legislation of minority , discussion on the function of special commodity management legislation of minority by the perspective of administrative rules and regulations, administrative regulations, Regulations on the Exercise of Autonomy, Specific Regulations, local laws and regulations in the minority. Explains special commodity economy legislation system, including perfecting "three preferential policies "; strengthening internal credit management system of bank; improving coordination mechanisms of departments relating to special commodity management; establishing coordination institutions to manage the special commodity of minority and regulating corresponding duties; founding support fund for special commodity; establishing reserve system for special commodity; establishing the mechanisms of human resources introduction and so on; dissertates legislative system of culture for special commodity, including folk art, technology cognition and protection three aspects. Through discussion on protection of minority human rights and demand of rule of law construction in our country, it's believed that it is urgent and necessary to legislate on the special commodity management in economy and culture two aspects.In a word, this article identifies the concept, history, legislative status and future development trend relating to special commodity management, with a view to provide reference for future legislation and research.
