On The Well-known Trademark Protection Of The Law

Well-known trademark has the features of high market-possession, high purchase-guiding ability and high acknowledgement. Therefore, it is more likely to be the target of passing off and unfair competition due to its commercial value. So it is necessary to establish the system of protection of well-known trademark. Based on the investigation of basic international conventions such as TRIPs Convention and the legal system of some developed countries and the status quo of legal system concerning protection of well-known trademark in China , this article discusses ways to provide special protection for well-known trademark, aiming at helping the establishment of special protection system of well-known trademarks . The discussion includes the standard and mode of identification of well-known trademark, the balance of rights between different market bodies, and the humble investigation of alienation of well-known trademark.
