Criminal Settlement System

In recent 30 years, one of the main topics about criminal justice reform ininternational judicatory circle is to create a kind of new judicatory mode, which benefits for both the protection of those victims and their returns to the society. At the foundation of criticism and review on traditional criminal justice's defects taken by law-governing western developed countries, the Victim-Offender Mediation was formed and developed, which is a type of new mode especially dealt with criminal debates. This new mode of ideal of law conforms to the general tendency of the society and gradually grows into an international trend, which has aroused a wide range of attention from China's academic and judicatory circle.Starting with the origin, development, theoretical foundation and ideal analysis, this thesis mainly quests the melting point of China's idealistic and cultural background, criminal policy, judicatory resources, criminal law and judicatory practice. After analyzing the necessity and feasibility whether China can introduce the Victim-Offender Mediation, this thesis concludes that this system should be used in China. And this thesis also put forward initial presumption on the establishment of this system in China, in order to provide sound and valuable advices to perfect China's criminal judicatory system.
