| Migrant workers are referred to as workers coming from villages to earn better money in cities. As an inevitable result from the serious conflict between China's industrialization process and existing registered residence system, migrant workers are a special social group in a specific historical time. In the historical process of building a well-off society in an all-round way, migrant workers have made great contribution to China's socialist modernization. However, because of the systems factors and people's lagging thoughts in cities, and of themselves' low education backgrounds and work skills, migrant workers' lives and rights in cities are aggressed to some extent.As a state system, legal aid system is not only an important part of our country's democracy and legality, but also an important judicial guarantee system like all other countries around the world. Providing legal aids to migrant workers, who are the disadvantaged group with huge number, is an important content for legal aid system's self development, and an important guarantee for our country's social stability and economic development.This paper describes the development of legal aid system in China, its current situation and shortcomings, meanwhile from a real point of view, demonstrates the importance and maneuverability of making and improving migrant workers legal aid system. Thorough describing the theoretical foundation, legislative lack, real inadequacy of migrant workers legal aid system, and comparing the domestic legal aid system with those abroad, the paper puts forward ideas to improve migrant workers legal aid system. The paper at last points out that to protect migrant workers' rights should not solely rely on the making and improving of migrant workers legal aid system, it needs the participation of all social resources in an all-round way, especially the social security. |
