On Legal Protection Of The Rights Of Migrant Community In China

In the present, China is concentrating on building harmonious society and a law-and-order nation. Harmonious society is equal society of people, by the people and for the people, in which no society groups of individual should be treated unequally. A law-and-order nation is one ruled by law, in which law should be the main measure to solve all kinds of social problems.There are about 1.3 billion people in China, among whom 1 billion are Peasants. As the largest social group in China, peasants have always been important to revolutionary and construction powers of China. Therefore, weather Peasant issues are properly copped with is critical for the social improvement and economic development of the whole society. The key is to aware and relieve peasant rights. In fact , because of historical and realistic reasons, peasant rights have long been ignored and discriminated both in legislative and judicial levels, which makes Chinese peasant an inferior social group. As a result, peasants' political, economic and social rights are underdeveloped, which in turn affeets the livings standard and development of peasants and hinders the building of harmonious society. Consequently, it is urgent for us to relieve peasant rights by means of law. In the system of the peasant rights, social rights are more urgent.The thesis is concentrating on the social rights of peasants. The first chapter introduces the basic theory problem of the peasants' social rights, including concept of social rights, its history and the reason of rising the problem of the peasants' social rights in present.The second chapter is about the problem in the security of the peasants' social rights, including the working, educational and social security rights, and then the author try to analyze the historical,social and systematic reasons of the poor of our country peasants' social rights.The third chapter is mainly about the revolutions of the problem, including the whole thought and specific measures we should take to guarantee and realize the peasants' social rights.
