On 1st January 1999,the European System of Central Banks(ESCB) had been set up.The Legislative body of EU and the European Central Bank had made a system of the law of central bank under the mandating of "TREATY ON EUROPEAN UNION" and its protocol including legislations at different levels and in varies of scopes.The research on the legal framework of the ESCB would give some suggestions on the building of a society ruled by law and how to intensify and perfect the government's macro-manipulation of our country.The dissertation is divided into four parts:The first part of it mainly discusses the European Monetary Union (EMU) and the European System of Central Banks with a conclusion that economic integration is the engine of EU integration and the EMU is the out coming of deepening of integration procession.The set-up of ESCB is the start of stage three of EMU and somehow the realization of it.The second part discusses the legal resources and legal system of ESCB with the result of discomposing of different resources of law including treaties,protocols,regulation,decisions,suggestions and opinions which are belonging to procedure law and substantive law, primary law and secondary law.The third part discusses the concrete content of the protocol on ESCB including the legal basis,goals and missions,structure,monetary policies and Judicial control and with a skeleton analysis of the legal system of ESCB.The last part of the dissertation conclude the transplanting of laws of central bank based upon the analogy of difference between ESCB and the central bank of China and give some suggestions on how to perfect our legal system of central bank from procedure,framework and Judicial control perspective.
