"The law of economic analysis based on legal rules of cost and benefit analysis and economic efficiency,we analyzed the results of the implementation of the law, and the conclusions of specific legal arrangements of social value evaluation.Robin Paul Malloy this sentence to the rule of law is the cost benefit analysis demonstrates a problem from the point of the assessment,and to some extent a cost benefit analysis form the core of legal economy analysis method.In China,administrative rules and regulations,regardless of their size and number or the scope and field,involved in the importance of the modern legal system is self-evident,but as the legal effect of the lower administrative rules in the formulation of process and no clear embodiment and application method of cost-effectiveness analysis,at least in part of administrative regulations on the level of legislation in the low efficiency of the implementation of potential pitfalls.According to the above problems,this paper cited economic cost-benefit analysis method in the process of administrative rules which should be considered in the marginal cost,cost(opportunity cost,social cost,cost and benefit conflict of economic and political benefits(discussion);time efficiency,in order to establish the administrative rule-making procedures and reinforce the cost-benefit analysis of the concept and method of purpose.Through the practice of some local governments to explore,case analysis for vehicles(Beijing) and the measures for the legislative law provisions survey,special emphasis on administrative rule-making cost benefit analysis of value,advice in administrative procedural law rule-making procedures in terms of the rules and regulations of the form of cost-effectiveness analysis method, and set up administrative rules and cost-effective forecast system and public accounting system,improve the petition of information disclosure and public participation in the implementation.Actually,the author emphasize perfect rule-making procedures of government and public two-way interaction,under the premise of using a cost-benefit analysis method to enact administrative rules,then expect through coordination mechanism of incentive compatibility rule-making procedures in the individual rationality and collective rationality of conflict.
