Open Government Information Ranging Study

The definition of open government information means what government should be accessed by the public, and what government information should not to be open. Concerning with this issue, the legislation ideal of "publication in principle, non-disclosure as exception" has been adopted by most countries. So the research of definition of open government information includes the concept of government information, the principle with which prescribes scope of open government information, and that of non-disclosure.Based on the introduction of regulations related open government information of other countries, the thesis is focused on the regulations of the Regulations on Open Government Information and local government information legislation, adopting comprehensives and analysis method of rules as well as typical cases.There are 7 parts of the thesis. Besides introduction and conclusion, the structure as follows:The 1st part prescribes the concept of open government information, as well as the purpose and significance of legislation on open government information from four points of view.The 2nd part is an introduction of regulations in Sweden, U.S., U.K. and Japan on this issue, especially on those of exception information, and summarize the common ground of these countries.The 3rd part is a description of the definition of government information ruled by China. There are 3 sections. The first section introduces the origin and development of open government information, the status of legislation in state and local governments. The second section, focus on discusses topics as the regulations on what is the government information, information opened actively and the exception. The last section is the analysis of discuss topic of open government information, as an example, the data of administration review cases in shanghai municipal government, as well as typical cases.The fourth part raises the existing problems in our current rules and practice, seeks the system, culture, and legal effect reason. At the same time, this part is focus on three problems must be resolved: differentiate and analyses of the concept of government information, right way to keep balance of open government information and protection of state secret and individual interest. The fifth part provides several suggestions to improve the rules on definition of open government information, from four aspects: to unify legal system, to amend the Regulations on Open Government Information, to draw up details regulations and rules, and to establish system of supervision and safeguard.
