Commercial bribery is a kind of bribery,not specifically the concept of criminal law.Countries all over the world define the concept of commercial bribery differently.On commercial bribery,China mainly embodies the concept of it in "People's Republic of China Against Unfair Competition Law" and the "Convention on the Prohibition of Commercial Bribery of Temporary Regulations".Elements o f commercial bribery—commercial bribery,kickbacks,added gifts,discounts and the relations of related acts are the theoretical and practical issues that must be solved if we want commercial bribery to be defined scientifically.As the international community recognizes the harm of commercial bribery in-depth,anti-commercial bribery legislation are maturing and warming,and in particular "the United Nations Convention against Corruption" was signed,pushing the anti-commercial bribery legislation to a new stage. China's anti-corruption legislation on commercial bribery has made substantial achievements,but we are faced with a lack and missing of the legal systems inside and outside there are demands linked with the "Convention" there for improving China's anti-commercial bribery legislation becomes urgent requirements to settle commercial bribery effectively.How to improve China's anti-commercial bribery legislation,it was advocated setting a unified anti-commercial bribery law,the author suggests the related legal systems should be revised and improved from administrative,economic,criminal aspects and so on.
