Copyright Infringement Damages

With the development of world economy, science and technology, the scope of copyright is expandingng, the type,carrier and the ways of dissemination on the copyright works are changable. In China, the phenomenon of the current serious copyright infringement on copyright infringement damages issue has practical significance.Paying for the infringement of copyright is a dutiful form to effectively protect the legal right of the writer and avoid him from being infringed .This dissertation, which is supported by general tort theory, draws lessons from the academic results in the field of copyright and other intellectual property rights field, to probe into the question of the asserting of tort of copyright and of the compensation of copyright infrigement.The disscussion on the types od torts is the begining of this paper .With the type of copyright as a criteria classification,the author analyzes the torts of copyright in terms of General Principles of Civil Law, the Copyright Law and other relevant laws, the analysis of regulations and judicial cases, ,and then to discuss the assert of copyright.In the copyright violations of the existing legal standards identified on the basis of copyright infringement damages attribution principle, the principle of compensation, the amount of compensation determined, and other aspects are described, and personal opinion and legislative proposals are put forward.
