Research Interests Of Policy Holders To Protect The Legal System

Insurance is the important service product in modern society. It is intensely connected with the daily life and commercial activities. As the insurance business develops fast and the insurance consuming groups expand ,there exists increasing conflicts when consumers are buying insurance products and accepting insurance service, so applicant's benefit is often invaded. Unfair phenomenon in the insurance Law, especially the unfair treatment applicants suffer has already become a focus of the society concern.This thesis is developed under the background of protecting the Rights and Interests of consumers; takes our country's Insurance Law revision as turning point; takes that applicant benefit protects legal system studying as centre; and takes that related problems of insurance contracting as the starting point. Four chapters are included in this thesis. Chapter 1 investigates the current situation in applicant rights and interests been invaded in our country and analyses the reasons; Chapter 2 analyses the current situation about applicant benefit protection in our country from three aspects, i.e. legislation , judiciary and administration; Chapter 3 analyses and summarizes the ripe experience on the applicant benefit protection in developed countries and areas; Chapter 4 based on the above-mentioned analysis, comes up with some ideas and suggestions about perfecting our country's applicant benefit protection from insurance legislation, judiciary and the law system of administrative supervision.
