Abstract/Summary:
Since the implementation of labour legislation in 1994, our country in the realm of labour law relation has already arrived implement from the lawmaking for 13 years. Within the more than ten years, the labour work system reform and the construction progress of the labour legal system had made a substantial progress, but also exposed a series of problems. These problems constitute the establishment background of the labour contract legislation, cause of this law set and become its social influence.In order to resolve the problems in the labour relation, the labour contract legislation comes into force on January 1 in 2008, and increases a lot of rulings which have not existed in past. The business enterprise thinks something legal now, which perhaps will break the law till 2008, for example the unit using the employee relieves contract , terminates contract not to pay economic compensation and agrees on penalty fee item at will, which are all impossible. Physically the unit using the employee sends back the employee to the unit sending the employee, and the both parties all can take no responsibility in the rent service, which are all impossible again. Particularly making the contract, if the employee does not make contract after a month from the day of work, the employee will be paid off twice wages. If using work not making the contract is full a year, the contract will be affirmed for not fix term. It is thus clear that the labour contract makes the responsibility heavier. So the business enterprise should modify the existing regulation system and labour contract according to the labour contract legislation to adapt the new situation after the labour contract legislation will be carried out on January 1 in 2008.In first, this thesis introduces the core principle and lawmaking aim to the labour contract legislation. Compared with the labour legislation which is promulgated implement in 1994, it puts forward the ten big breakthroughs for the labour contract legislation.Next, the thesis analyzes the influence, hazard and new opportunity on system human resource for the power company, when the labour contract legislation is executed. Then this thesis introduces the present condition and the existing key problem at present on the human resource in someone power company.Finally, the thesis carries on a study to the measure which resolves the existing key problem at present of the human resource, and puts forward the whole members in the power company system to study and carry through labour contract legislation in order to strengthen human resource management.
