Civil Summary Perfect

The civil procedure takes the simple, fast closing and low-cost proceedings as the basic characteristics and plays a significant role in complexity streaming rational allocation of judicial resources. However, the current lack of relevant legislation in China leads to the confusion and the specific operations on their own in the judicial practice and ultimately makes it deviated from the two basic proceeding objectives of justice and benefits. This paper further produces its own concept to improve China's civil summary proceedings on the basis of the successful experience of foreign countries through the superficial analysis for China's adoption of the existing problems on legislation and judicial practice according to the basic civil legal basis. The writer writes this article in order to seek more attention on this issue from substantive academic and judicial circles.
