Potential Damage Study

With the development of China's legal society progress ,the good situation of society harmony and stability requires that China's criminal legislation expound the effect of the punishment and prevention,especially facing many problems such as coal mine accidents, serious river pollution, mines and fires accident, construction accidents and other major accidents.In order to support the effective implementation of laws and regulations ,in the way of increasing the legal responsibility of the leading person to prevent from happening the of major accidents, the author advocates that we should set up the theory of involuntary dangerous crime in the field of public safety. In this paper, the author inspectes the legislative cases from the world's major countries about this aspect in the empirical analysis way .so that,it is inevitable for us to futher demonstrate the legislation of involuntary dangerous crime. At the same time , the author analyses the reasonableness of the legislation in the field of the fault theory .Finally,the author reconstructs the theory of involuntary dangerous crime of our country in this paper.
