Marine Insurance Subrogation Claim

Subrogation is a special provision in property insurance, and is also a complex rule for three parties'rights simultaneously involved. As for the current legislation in China, a complete system of the Maritime Subrogation has come into form, which plays an important role in protecting the insurers'rights so as to make the litigation of Maritime Subrogation go on wheels. But the system has some flaws and conflicts between provisions can always be found. With theories in civil laws as the basis, the thesis is focus on the defects in the system of Maritime Subrogation.Chapter 1 firstly introduced the concept and the meaning of the Subrogation; meanwhile a general review and a brief comment were given to the legislation and the history of it, and also discussed the purpose of the legislation, especially the nature of the subrogation. Chapter 2 and 3 gave a further study on substantive aspects of the Maritime Subrogation;Chapter 4 involves some procedure problems of it.
