Along with the social development, non-government organization gradually plays an important role in political and economic life. Some association organizations, as well as some volunteer organizations start to implement the public management for public business by the way of cooperating with government. This means the government isn't the monopoly which exercises the public power any more, non-government organization also obtain some public management power, it participates in the public administration and has already become the stirring focus in public administration. Accompany with this process, the social public administration gradually attract public attention, most of the modern countries began to bring the social public administration into its scope and study its position,its right and obligation in social public administration as well as some other closely-related questions which will affect its existence and development. In our country, along with the continuously thorough administration reform, non-government organization exercising public power becomes a day by day common phenomenon. Beside this, the diversified development of management style also produced certain impact to the existing administration mode, more and more people recognize the importance of the non-government organization, and the research about the non-government organization tends towards deepening. But there is a fact which we should realize is, as the study of administration in our country takes national administration as its core in pre-period, the administration method still keeps inclining towards "management" and "control", the government still takes an old-fashioned attitude towards the non-government organization. This attitude result in some problems which eagerly need the juridical response , such as : the misunderstanding of the non-government organization, the misstatement of its character, the lack of enough control to the non-government organization etc.In this text, we try to research on the social public administration, basing on the citizen society theories,the analysis and demarcation of the social public administration, we want to gain a clear definition about the social public administration. Further more, we will analysis its legitimacy foundation, and discuss some basic problems which relate to the legal rule of the social public administration. In our opinion, the existence of social public administration is the inevitable outcome of the economic system reform and political setup reform, the blemish which it exposes in the process of development made the law rule seems be imperative under the situation. However, currently our country's research on social public administration is still on an entry-level stage, the law restriction on the social public administration is still faulty and far from satisfies the realistic need of the development of social public administration. Aim at these problems, we contrast our country's condition with other's, point out blemish that currently exist in our country's social public administration, and put forward rules and regulations path which our country can choose in current stage.
