Labor Rights In The Constitutional Research Of The Theoretical Analysis Of Legal Protection

Through the concept of domestic and foreign labor right,we may know labor right is the foundation of social economic right, the core of fundamental human rights, a constitutional basic right, an item of parently substacial right. She can derive many sub-rights and the grandson right . Labor right and its derivative right mainly exist in the employment process, the working process as well as the collective Uygur power process. Labor right has experienced the voluntary, the moral stratification plane right, in the social power important right, the fundamental human rights in constitution and the international human rights. Analyzing from the nature, our country's labor right has dual attributes, the property rights based on worker's labor and the right of using freedom. About the content, our country's labor right is containing the equally employment right, the resting right, the rewarding right. The construction of constitutional government requests us to establish one legal system that is taking a center based on the constitution and coordinating with many kinds of concrete , dynamic, three-dimensional, omni-directional, the multi-level worked, the national realized citizen's labor right. It is our inevitable choice to protect labor right from adjusting basic point ,constructing constitutional system of trial, and strengthening related legal as well as synchronized system construction.
