| P2P file-sharing network, as a wider use of information share platform, definitely affects the operation of the relevant industries, which results in repeated waves of litigation copyright disputes in USA and EU, etc.China's mainland and Hong Kong have begun to arise concerning litigation related to P2P network technology. Based on the law and economics research tools, a number of copyright law issues are analyzed under the P2P environment, such as externality, remuneration rights and indirect liabilities.And from three typical cases: Napster Vs RIAA, Grokster VS MGM and Kazza, the author makes insight into the relevant copyright legal practices.After reviewing the relevant literatures, the cause of booming for P2P network technology and the profound impact on copyright law, the dissertation aims to give some help on the implications of copyright law in China, as well as better protection the interests of copyright-holders, the legal use of copyrighted works rights for the end-users in computer public networks, reasonable restriction to the negative impacts, promoting the positive effect on the dissemination of information. Through the perspective of law and economics, the dissertation hopes to investigate a reasonable legal mechanism, to reconcile their conflicts, and to achieve the optimum configuration of network resources, which is the orientation of copyright legislation. |
