Encouragement

Encouragement investigation is a special investigation measure in criminal prosecution, it was used in our criminal detection, but it is not exist in our criminal prosecution law. also it is a new area in the theory. Encouragement investigation has high efficiency, while facing the criminals which have high hidden,harm, it is propitious to the social order. But because of its temptation,hidden, it is easy to violate the legal right of the civics, so we should rule it effectively. This article has four parts. In the first part, the penman discuss the conception of encouragement investigation, then distinguish encouragement investigation and correlative conceptions, and discuss its validity and reason. In the second part, the penman investigate the main body of the encouragement investigation, emphasizely analysis the force adeffect of the two kinds encouragement investigation, and discuss the criminal exempt of the wiring person, then analysis the legal effectiveness of the civilian researchment. In the third part, I research the startup condition, startup procedure, implement procedure, supervise procedure, analysis the procedure request of the encouragement investigation. In the forth part, the penman analysis the principal, the legal limit of encouragement investigation, the legal sequent of inappropriate tempt to rule the action of the encouragement investigation.
