On The Construction Of The Chinese Agricultural Industry Security Legal System

After the entry into WTO, an overall opening-up pattern has taken shape in China. The industrial security of agriculture has become a strategetic affair which has great effect on lasting stability and durable peace of China, and will lead the future of development for the country. It is an important task for the economic development of China that to maintain the industrial security of agriculture under the precondition of continually widen and expedite the opening-up.But at present, there is no law system on industrial security of agriculture built in China. And the legal measure to ensuring the industrial security of agriculture is comparatively simple. Referring to the legislation and experience of the developed country and area such as EU, US and Japan, the author tries to give some suggestions on how to build our law system of industrial security of agriculture, based on the research to the defect of our law system.The article includes five parts. The first part introduces the theory for industrial security of agriculture. The second part introduces what we promised in the field of agriculture on the entry into WTO. Based on real material and data, an analysis is made on what the entry into WTO brings to our agriculture industry and on the problem caused in industrial security of agriculture. Also an enumeration is made on the status and defect to our present legislation for ensurance on industrial security of agriculture. The third part introduces an analysis on the relative law and legislation about industrial security of agriculture in US, EU and Japan. With reference to the lawmaking experience of the above developed country, Suggestions are made on the construction of our law system on industrial security of agriculture.
