Under the current condition of our country, should the criminal has sex right exactly? If the criminal has the right, could it be performed during the serving period? When there is no definite rule in law, is the method suitable? Which issues will it run into in laws, managements and even ethics? Combining with present legislation situation and practice in china ,this article starts from the legal definition of the criminal's sex right. It discusses the advantages and disadvantages of the criminal's sex right deeply from the positive and negative aspects. The article indicates that, under the tendency of humanism, though the origin of enforcing "The cohabitation meet" is indubitable, there is no definit rules in law, that is, the foundation of law is deficient and the feasibility is not strong, meanwhile, the social ground and the criminal's identities are special in current china, therefore the issue of the criminal's sex right creates many actual problems. At the end of the article, it introduces three logical points as suggestions which points that the humanism management should not be enforced hastily, but the step of legislation should be accelerated and the theoretical research should be enhanced nowadays, so that these will be benefit to the prison practice work to some extent.
