Chinese State Monopoly Of The Legal Regulation Of The Problem Research

Monopoly and free competition are twins of the market economy. There are various kinds of monopoly. In China, it is national monopoly that has the most strength, the broadest affect and the closest connection with people's life. Relying on the support of system, national monopoly showed itself from the planned economy times, and so far, it is still playing a very important role in our economy. It is fair to say that national monopoly has great contribution in the past. However, situation has changed. National monopoly is increasingly going against its initial purpose, and in some extent hinders the development of market economy and the formation of integrated market. In this background, the paper aims to attract people's attention to the national monopoly, and attempt to make some exploration on how to regulate national monopoly effectively.The paper can be divided into three sections. The first section introduces the connotation and features of national monopoly and makes some comparison between national monopoly, economic monopoly and administrative monopoly. The second section summarizes theoretically the historic causation and practical defect of national monopoly and expatiates on the necessity and imminence to effectively regulate national monopoly. The last section puts forward some suggestions and proposes on how to regulate national monopoly effectively, such as to consummate the Antitrust Law, to strengthen the regulation on monopoly industry. In view of that academe has paid much attention to administrative monopoly and economic monopoly but not enough to national monopoly, the author hopes that tin's paper can bring more and more scholars to ponder and research the issues relating to national monopoly, with a view to get a fruitful result both in legislation and practice by this dissertation.
