As a result of reform and open policy, our country of economy, the political and social structure has greatly changed. The sole analytical method of dividing the social members into different classes can't explain many existent social phenomena exactly. Thus social stratum theory in the social science realm of our country has been paid more and more attention to. New visual field will be achieved and new way to solve many social problems will be found when the theory is used for analyzing the moral construction and legal system construction. At present, the social governors (officers) and members to be governed (common people) within the social stratum both present new characters. Both are very different in their social status, economic condition, value view and social resources controlled from before the reforming. This text is exactly according to their dissimilarities, then put forward that we must consider the differences between the two stratums in the morals construction and the legal system construction, so we can aim at the key point and treat the two stratums differently.This text commences from the social stratum theories, pointing out the function of this theory in analyzing current social phenomena in the first part; then discussed officers and common people's different characters, which provide theoretical support for classifying the two stratums in morals and legal system construction. The consequent research shows how the governors treat the officers and the common people in the Chinese ancient times. In the third part, the writer subsequently investigates how the foreign governors treat the officers and people differently in morals and the legal system constructions. By comparison, the writer draws a conclusion that they usually have higher morals standard and stricter law standard to treat officers. In the end, the author propose several valuable suggestions.
