Trade facts in the history told us that trade protection is the mainstream inthe history of international trade. Under current international trade conditions,the function of trade protection is ignored or even disavowaled by somepeople. In fact, the existing of trade protection is reasonable and absolutelynecessary and trade protection will not disappear in a long time. In the frame ofWTO there are even legal approaches for WTO members to enact necessaryand reasonable legal system of trade protection. So this dissertation studies thegradual development of the legal system of trade protection taken by countriesto find the trend which we can use for reference to develop the intemationaltrade system and perfect our international trade system.The identified concepts relating to the thesis are clarified. The legalsystem of trade protection is compartmentalized into four stages. The first oneis the early legal system of trade protection, which is from 15th century to 17thcentury. Then the neoteric legal system of trade protection is from the late 18thcentury to the middle of 19th. After that is the contemporaneity legal system oftrade protection, which is from the early 20th century to the end of the worldwarâ…¡. The last stage, called the present legal system of trade protection, is theone after 1970s.With looks back on the background and the theories of the legal system ofthe trade protection and collecting laws and regulations relating to the tradeprotection in the main countries, the legal characteristics and the implementaryimpact of the legal system of trade protection in different stages areanalyzed. The theories of the legal system of the trade protection are from themercantile system to the new protectionism. The trade protection policy isfrom pure trade protection to the free trade policy with trade protection. Andthe process of forms and scope of the system is also clear.Using the history as a mirror, the author holds that our government andindustrial circle should face the reality that the legal system of trade protectionobjectively exists. It's urgent for us to carefully research countermeasures andenact our own legal system of trade protection so as to protect domestic marketand industries.
