Police Defense Research

Police defense is defined as the counterattack act and moderate violent measure according to the law in terms of execution of police duty which aims at deterring or punishing crime for the sake of social security maintenance and law enforcement. Police defense is the required right that police is endowed with by the law, as well as the required duty for police.This paper dedicates to illustrate the nature and characteristic, as well as the significance of police defense in Chinese criminal law system in the respect of the differences between police defense and justifiable self-defense of citizens. It has been divided into three parts.Part one states the concept and character, feature of police defense as well, which also indicates the correlations and differences with regarding to comparing police defense and justifiable self-defense of citizens. Meanwhile, it to some extent carries out some comparisons and researches at police defense system.Part two focuses on analyses and illustration in frame of conditions for police defense, as well as features and legal responsibilities of improper police defense.Part three devotes to launch out significance of police defense system in Chinese criminal law system, and considerations on constructing and improving police defense system.
