Land is what villagers rely on. Protecting their land rights and interests isprotecting their basic interests. As far as the system arrangement is concerned,the related laws and regulations are principally equal to all the citizens.However, it's common phenomenon that rural women's land rights andinterests are violated. It has negative effects on the justice of interestsdistribution and political stability in our country.This article through the comparative analysis and cases analysis on therural women land rights and interests, finds out the reasons for the fact that therural women land rights and interests are violated, and aims at the proposalsin the pearl delta areas in Guangdong province about this question.In the areas that farming is vital, the household contract responsibilitysystem is not favor for the individual land rights and interests because it hasn'ta clear definition of collective member. As a result, the rural women's landrights and interests are often deprived. To avoid the insufficiency of thecollective economy property right, the pearl delta areas in Guangdongprovince leads the reform of cooperative system in rural China and makesprogress in defining property right. Since the innovation is at the start stage,the design of the system has some insufficiencies and the property right is notclear. The criteria of the shareholder qualifications are hot-disputed. With thedevelopment of the rural economy and urbanization, the contradictory of thehuman and land become more outstanding in the pearl delta areas inGuangdong province. The cultivation use of the land greatly degenerated, andthe benefits of the homestead, compensation and the stock become more andmore. Under the actuation of the benefits and the influence of the traditionalideas, the villagers' committee deprives of the women's land rights andinterests in the name of democracy. Furthermore, the laws and regulations arecontradicted. It is hard for the rural women to protect their rights and intereststhrough the judicial channel. This article insists that to make equal land rights between men andwomen of rural areas, many things must be done. We should consummate thelegal framework, restrain the villagers committee's administrative power andaction, search for the balance point between traditional custom and moderncivilization and provide the judicial relief to the rural women. In a word, throughthe legislative, administrative and the judicial methods, coordinate the benefitrelationship among the local authority, the villagers' self-governanceorganization and the villager individuals, and guarantee the rural women toobtain the equal treatment in benefits.
