Judicial independence has become a common focus in international communication. And to establish and pursue judicial independence has become an international tendency. As the result of our systemetically obstacle, we are confronted with various problems to earn judicial independence at present.Everything as well as natural phenomenen and social system all requires necessary condition to emerge , exist and develop. How to analyse and unscramble that condition is critical, it is the first step for us to understand, analyse and even create new things. Presently,there still exist large vacancies in the condition research of judicial independence of our country while most research ignoring to demonstrate it in concrete historical background. Therefore,the lack of condition research on judicial independence under its original background absolutely restricted the execution of this theory in practice in our country, and people are puzzled with various of new concept.As the representative of western legal system, Britain is the earliest country which realized the judicial independence that went through three period: emergence, development and establishment. Its concept, theory and system on judicial independence were accepted and imitated by most of the countries in the world all along. To research the emergence and development conditions of British judicial independence system from the point of history has far-reaching significance to help China solve the problems of judicial independence.Long-term formed tradition of respecting law, developed economy, separation of powers and the form of professional legal community together provided essential ideological, economic, political and professional conditions for the finally establishment of British judicial independence system. Conditions wouldn't be formed in short time, it should be cultivated through long time and in special background.
