In order to contain this kind of the behavior of discarding the solid waste at will, reduce the production quantity of the solid waste, simultaneously benefit to the solid waste recycling use, Overseas some countries as early as in 20th century 70's have been on through legislation, in view of certain specific products gather the deposit to the consumer when sale. The consumer can bring back the deposit after using the product and then returning the remaining. The practice proved that, this system in the aspect of protecting environment, enhancing the recover-ratio and the use-ratio of the solid waste has the extremely splendid function. In view of this, the author suggested establishes an item of environment deposit system in our country. This system may promote the economy to grow, realize resources continue to use forever, prevent the solid reject to discard at will, improve environment, promote society develop harmoniously, simultaneously raise citizen's environmental protection consciousness.The paper was divided into five parts to elaborate this question. The first part was an introduction. It mainly introduced the paper's background of selecting the topic, and the research of the content, the significance and the method. This part made upholstery forfollowing writing; The second part was the research of legal principle theory of theenvironment deposit system. This part had made some discussion from the angle of thelegal science theory for the environment deposit system. This part first summarized the concept and the characteristic of the environment deposit system. Once more, introduced how in the environment deposit system the national environment authority exercises. It showed establishing this system's legal principle theory of foundation. Finally, discussed the environment legal liability in the environment deposit system; The third part was the necessity and the feasibility of establishing the environment deposit system in our country. First, elaborated the necessary question from the real life's urgent needs and the present legal insufficiency. Next, from establishing environment deposit system had the policy to make safeguard and the environment deposit system itself has the economical rationality two aspects to elaborate the feasible question. The fourth part was the introduction of some overseas countries' environment deposit system and to our country's enlightenment. Through introducing some countries' environment deposit system such as Sweden,Germany,US etc, proposed our country establishes this system; The fifth part was the environment deposit system's construction in our country. The author first elaborated the environment deposit system's content in our country from following several aspects: Environment deposit's applicable scope, the standard of collecting environment deposit, how to return the environment deposit, how to handle the recycling goods, the legal liability for violate the environment deposit system and how to solve dispute. Finallythe author drafted an administrative law—"The Collection and Policing method ofEnvironment Deposit to Special Product and Packing material". Hope to play a certain reference role in setting up the legal system of environment deposit by relevant departments.
